Terms and conditions for using novavision analytics services
By accessing and using the novavision website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. These Terms of Service constitute a legally binding agreement between you and novavision Ltd, a company registered in Malta with registration number C36985.
novavision provides cosmetic product performance analytics tools and services designed for beauty and spa businesses. Our platform offers data analysis, reporting, customer insights, and market intelligence to help businesses optimise their product performance and make informed decisions.

We strive to maintain high availability of our services, but we do not guarantee uninterrupted access. Our services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.

For paid services, payment terms will be specified in your service agreement. Unless otherwise stated, payments are due in advance and are non-refundable. We reserve the right to suspend services for non-payment. All fees are quoted in Euros and exclude applicable taxes unless otherwise stated.
All content, features, and functionality of our website and services, including but not limited to text, graphics, logos, software, and analytics algorithms, are the exclusive property of novavision Ltd and are protected by copyright, trademark, and other intellectual property laws. To the fullest extent permitted by law, novavision Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services. Our total liability to you for any claims arising from these terms or your use of our services shall not exceed the amount paid by you for our services in the 12 months preceding the claim.
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be error-free, secure, or available at all times.
You agree to indemnify and hold harmless novavision Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, your violation of these terms, or your infringement of any third-party rights.
These Terms of Service are governed by and construed in accordance with the laws of Malta and the European Union. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Malta. If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
Either party may terminate this agreement at any time with appropriate notice as specified in your service agreement. We reserve the right to terminate your access to our services immediately if you violate these terms. Upon termination, your right to use our services ceases immediately, and we may delete your account and data in accordance with our data retention policies.
Upon termination, you remain liable for any outstanding fees and obligations incurred before termination. Provisions relating to intellectual property, limitation of liability, indemnification, and governing law shall survive termination.
We reserve the right to modify these Terms of Service at any time. We will notify you of material changes by posting the updated terms on our website and updating the "Last Updated" date. Your continued use of our services after such modifications constitutes acceptance of the updated terms.
These Terms of Service, together with our Privacy Policy and any additional service agreements, constitute the entire agreement between you and novavision Ltd regarding your use of our services and supersede all prior agreements and understandings.
